TICKET EXCHANGE AND REFUND POLICY
1. General provisions.
1.1 The basic concepts used in these Rules mean the following:
- Organizer - ROTEX LLC;
- Exhibition - the exhibition "Body Worlds", held by the Organizer at the address: 129223, Moscow, Prospekt Mira, 119, VDNH, Pavilion 21, visiting which is possible only on presentation of a special document - a ticket/e-ticket.
- Ticket/e-ticket - a document containing a barcode/QR-code certifying the holder's right to attend the Exhibition on the date specified in the ticket;
- Family ticket, group ticket - a type of ticket/e-ticket purchased at the appropriate fare for a group of persons;
- Ticket agent - a legal entity or an individual entrepreneur, or a person engaged in independent professional activities, authorized by the Organizer to sell tickets/e-tickets to the Exhibition, which is charged with the obligation to refund the cost of the ticket/e-ticket in case of its return;
- Visitor means a person entitled to attend the Exhibition, who has paid for a ticket/e-ticket.
1.2. These rules are developed in accordance with the Federal Law of the Russian Federation of February 7, 1992 № 2300-1 "On Protection of Consumer Rights", the Civil Code of the Russian Federation, the Law of the Russian Federation of October 9, 1992 № 3612 "The basic legislation of the Russian Federation on Culture" as well as the Russian Federation Government Decree of 18.09.2020 № 1491 and regulate the sale, exchange and refund of tickets for the Exhibition.
1.3. These Rules are communicated to visitors by posting them in the Ticket Office, on the official website of the Exhibition http://bodyworlds.moscow and at the Ticketing Agents' points of sale.
2. Procedure for selling tickets.
2.1 A visitor (buyer) may purchase tickets/e-tickets to the Exhibition:
- at the Exhibition's cash desk at the address: Moscow, Prospekt Mira, 119, VDNH, pavilion 21;
- on the official website of the Exhibition http://bodyworlds.moscow;
- at the points of sale of Ticket Agents (including the official websites of the Ticket Agents) authorized to sell tickets/e-tickets on the basis of appropriate agreements.
2.3. E-ticket sales are conducted on the Exhibition website, as well as on other websites authorized to sell tickets under the relevant agreements.
2.4. The Organizer is not responsible in any way for purchasing tickets to the Exhibition from persons who are not official Ticket Agents of the Organizer.
2.5. When purchasing tickets/e-tickets, the visitor has the right to receive comprehensive information about the Exhibition, the availability of benefits, and the rules for visiting the Exhibition.
2.6. By purchasing a ticket/e-ticket for the Exhibition, the Buyer confirms the conclusion of a contract for the provision of services, as well as acceptance of the Rules for Visiting the Exhibition and these Rules. The agreement for the provision of services shall be formalized by issuing the ticket/e-ticket and the cash receipt to the buyer. The ticket/e-ticket is a document in a prescribed form which contains information about the terms and conditions of the contract with the consumer.
3. Ticket/e-ticket refund procedure and conditions.
Tickets purchased at the Ticketing agents' points of sale are accepted for return by the Ticketing agent from whom the ticket was purchased, in accordance with the procedure established by the particular Ticketing agent.
The rules for refunding tickets purchased at the Exhibition's box office at 119, Prospekt Mira, VDNH, Pavilion 21, Moscow, as well as for e-tickets purchased via the Exhibition's official web-site http://bodyworlds.moscow shall apply according to par. 3.1, 3.2, and 3.3 of these Regulations.
Tickets purchased at the Exhibition's cash desk, as well as e-tickets purchased on the Exhibition's official website http://bodyworlds.moscow are accepted for refund or exchange directly at the venue of the Exhibition: Moscow, Prospekt Mira, 119, VDNH, pavilion 21, on the basis of the buyer's personal statement and upon presentation of an identity document, namely:
- Passport of a citizen of the Russian Federation;
- Russian passport (for Russian citizens permanently residing outside of Russia);
- The identity card of a serviceman of the Russian Federation; the military card of a soldier, mate, sergeant, petty officer, warrant officer and midshipman;
- Temporary identity card of a citizen of the Russian Federation (form N2P);
- Birth certificate;
- Service certificate of a prosecutor's officer (article 41.1 of the Federal Law "On Prosecutor's Office of the Russian Federation" №2202-1 from 17.01.1992);
- Seaman's Identity Card;
- Temporary residence permit (for foreign nationals);
- Residence permit (for foreign citizens);
- Passport of a foreign citizen or any other document established by federal law or recognized in accordance with an international treaty of the Russian Federation as an identity document of a foreign citizen.
3.1. The procedure and conditions for the return of tickets/e-tickets to the Exhibition by the visitor in case the visitor cancels his/her visit to the Exhibition on the visitor's initiative.
3.1.1. If a visitor cancels his/her attendance at the Exhibition for reasons other than illness of the visitor or death of a person who was a family member or a close relative under the Russian Federation Family Code, the visitor has the right to apply for a refund of the ticket/e-ticket and a refund for the unused ticket/e-ticket (hereinafter - return application).
3.1.2. An application for refund shall be submitted by the visitor (his/her representative) to the Exhibition's cash desk, or sent by the visitor by registered mail with the list of enclosures and proof of receipt.
3.1.3. The submission of an application for refund is made at the Exhibition's cash desk upon presentation of the visitor's (his/her representative's) ID document.
If the application for refund is sent by mail, a copy of the visitor's identity document shall be attached to the application for refund.
3.1.4. The original copy of the unused ticket to the Exhibition must be enclosed to the refund claim. When returning an e-ticket, the printed copy of the e-ticket, as well as a copy of the electronic cash register receipt shall be attached to the refund application.
3.1.5. If the return application is submitted by the visitor's representative, copies of documents confirming legal representation or a duly executed power of attorney shall be attached to the return application.
3.1.6. The application for refund and the attached documents are accepted and registered on the day of their receipt.
At the request of the visitor (his/her representative), a note of receipt of the return application and accompanying documents shall be made on a copy of the return application, indicating the list of documents and the date of receipt, or a reply of receipt shall be sent to the e-mail address specified in the return application (if the return application specifies the need to send a note of receipt by e-mail).
3.1.7. Within a period not exceeding 10 days from the date of receipt of the application for refund and the documents attached there to, the Ticket agent shall examine them, decide on the refund for the unused ticket/e-ticket, or refuse to refund in case of non-compliance of the visitor to the conditions specified in paragraph 3.1.11 of these Rules, and inform the visitor (his representative) about it.
3.1.8. The Ticket agent informs the visitor (his/her representative) about the decision to refuse a refund, specifying the conditions stipulated by paragraph 3.1.11 of these Rules, non-compliance of which was the basis for such refusal, not later than 5 days after the decision on such refusal is made by one of the following ways:
- delivers to the visitor (his representative) a written notice of refusal to refund the money for the unused ticket (e-ticket);
- sends a notice of rejection by registered mail with return receipt requested to the address listed on the return application;
- sends a copy of the notification of refusal to the e-mail address specified in the application for return.
- The method of notifying the visitor of the Ticket Agent's decision to refuse a refund is specified by the visitor in the refund application.
3.1.9. The Ticket Agent notifies the visitor (his/her representative) of the decision to refund the money to the visitor (his/her representative) by e-mail or telephone no later than 3 days from the date of such decision.
The method of informing the visitor of the Ticket Agent's decision to refund money is specified by the visitor in the application for refund.
The ticket agent refunds the money to the visitor no later than 10 days from the date of the decision to refund the money. The method of refunding the visitor is determined similar to the method of payment for the ticket by the visitor.
3.1.10. The amount of money to be returned to the visitor for the unused ticket/e-ticket is calculated by the Ticket Agent in accordance with the provisions stipulated by parts eleventh and twelfth of Article 52.1 of the Laws of the Russian Federation on Culture, namely:
- no later than 10 days before the date of attendance at the Exhibition specified in the ticket, the visitor has the right to get back 100% of the ticket price;
- less than 10 days, but no later than 5 days before the day of the visit specified in the ticket, the visitor has the right to get back 50% of the ticket price;
- less than 5 days, but no later than 3 days before the date of the visit indicated on the ticket, the visitor has the right to get 30% of the ticket price back.
If a visitor cancels his/her visit for reasons other than illness or death of a person who was a family member or a close relative under the Family Code of the Russian Federation less than three days before the date specified in the ticket, the visitor will not receive a refund for the ticket.
3.1.11.In case the visitor refuses to attend the Exhibition for reasons not related to the visitor's illness or the death of a person who was a family member or a close relative under the Russian Federation Family Code, the visitor has the right to return the ticket/e-ticket under the following conditions:
a) the form and details of the ticket/e-ticket correspond to the approved form and details; the design elements of the ticket/e-ticket correspond to the design elements established by the Exhibition Organizer, the ticket/e-ticket does not contain any corrections and is not forged;
b) an application for a ticket/e-ticket refund is submitted to the Ticket Agent at least 3 days prior to the date of the visit to the Exhibition, indicated on the ticket/e-ticket;
c) the application for refund and the attached documents are submitted in accordance with the provisions stipulated in paragraphs 3.1.2. - 3.1.4. of these Rules.
3.2. The procedure and conditions for the return of tickets/e-tickets to the Exhibition by the visitor in case the visitor refuses to attend the Exhibition due to documented circumstances related to the visitor's illness.
3.2.1. If a visitor refuses to attend the Exhibition due to illness, the visitor has the right to apply for a refund due to illness.
3.2.2. An application for a refund due to illness shall be submitted by the visitor (or his/her representative) to the Exhibition's cash desk, or sent by registered mail with the list of enclosures and return receipt requested, or in electronic form, indicating the enclosed documents, no later than the day of attendance at the Exhibition as specified in the ticket/e-ticket.
3.2.3. Submission of an application for refund due to a disease shall be made at the Exhibition's ticket office upon presentation of the visitor's (his/her representative's) ID document. The application for a refund due to illness, if sent by mail or electronically, shall be accompanied by a copy of the visitor's ID document.
3.2.4. The application for a return due to illness shall be accompanied by:
a) the original unused ticket to the Exhibition, or a printed copy of the unused e-ticket, as well as a copy of the electronic cash register receipt;
b) a copy of a disability certificate or certificate (medical report) issued by a medical organization in accordance with the legislation of the Russian Federation and confirming the fact of the visitor's illness that prevents him/her from attending the Exhibition.
3.2.5. The application for return due to illness, if submitted by the visitor's representative, shall be accompanied by copies of documents confirming legal representation, or a duly executed power of attorney.
3.2.6. If the visitor is unable to submit the documents specified in subparagraph "b" of paragraph 3.2.4. of these Rules within 14 days from the date of visit specified in the ticket, provided that the application for return due to illness and other documents specified in this section are submitted by the visitor within the period specified in paragraph 3.2.2. of these Rules.
If the visitor submits an application for refund due to illness in electronic form, the visitor submits the original application for refund due to illness and the documents specified in paragraph 3.2.4. of these Rules, not later than 14 days from the date of the visit, specified in the ticket.
3.2.7. The application for return due to illness and the documents attached to it are accepted and registered on the day of their receipt.
At the request of the visitor (or his/her representative), a note shall be made on a copy of the application for a refund due to illness, indicating the list of documents attached thereto and the date of receipt, or a reply on receipt shall be sent to the e-mail address indicated in the application for a refund due to illness (if the application for a refund due to illness indicates the need to send a note on receipt by e-mail).
3.2.8. The ticket agent within 10 days from the date of receipt of the application for the return in connection with the disease and the documents attached to it examines them. If necessary, this period of consideration may be extended up to 30 days.
In cases stipulated by paragraph 3.2.6. of these Rules, the period of consideration is calculated from the date of receipt by the Ticket agent in full of the documents specified in paragraph 3.2.4. of these Rules.
3.2.9. After reviewing the application for refund due to illness and the documents enclosed the Ticket agent makes a decision to return the funds for the unused ticket/e-ticket or refuse to return the funds if the conditions specified in clause 3.2.12 of these Rules are not met and informs the visitor (his/her representative) about it.
3.2.10.The Ticket agent informs the visitor (his/her representative) about the decision to refuse a refund indicating the conditions stipulated by Clause 3.2.12 of these Rules, non-compliance of which was the basis for such refusal, not later than 5 days from the date of the decision by one of the following ways:
a) deliver to the visitor (his or her representative) a notice of refusal;
b) send a notice of refusal by registered mail with return receipt requested to the address indicated in the application for return due to illness;
c) send a copy of the notification of refusal to the e-mail address specified in the application for return due to illness.
The method of notifying the visitor of the Ticket Agent's decision to refuse a refund is specified by the visitor in the application for a refund due to illness.
3.2.11.The Ticket Agent notifies the visitor (his/her representative) of the decision to refund the full cost of the ticket/e-ticket by e-mail or phone no later than 3 days after the decision to refund the money to the visitor (his/her representative). The method of notifying the visitor of the Ticket Agent's decision to refund the money is specified by the visitor in the application for a refund due to illness. The Ticket agent refunds the money to the visitor no later than 10 days after the decision to refund the money has been made. The method of refunding the visitor is determined similar to the method of payment for the ticket by the visitor.
3.2.12. In case a visitor refuses to attend the Exhibition due to documented circumstances related to the visitor's illness, the visitor has the right to return the ticket/e-ticket under the following conditions:
a) the form and details of the ticket/e-ticket correspond to the approved form and details; the design elements of the ticket/e-ticket correspond to the design elements established by the Exhibition Organizer, the ticket/e-ticket does not contain any corrections and is not forged;
b) the application for refund due to illness and the documents attached thereto (except for the cases stipulated in Clause 3.2.6 of the present Rules) are submitted to the Ticket Agent or are sent by registered mail with the list of enclosures and notification of receipt no later than the day of the visit to the Exhibition, indicated in the ticket;
c) the documents specified in paragraph 3.2.4. of these Rules are submitted within the deadlines established by these Rules;
d) the application for refund due to illness and the documents attached thereto are submitted in accordance with the provisions stipulated in paragraphs 3.2.2. - 3.2.6. of these Rules;
e) the documents submitted contain reliable information;
f) the ticket/e-ticket was purchased prior to the visitor's illness preventing him/her from attending the Exhibition.
3.3. The procedure and terms for the return of tickets/e-tickets to the Exhibition by the visitor in case the visitor refused to attend the Exhibition due to the death of a person who was a family member or a close relative thereof in accordance with the Family Code of the Russian Federation.
3.3.1. If a visitor refuses to attend the Exhibition due to the death of a person who was a family member or a close relative in accordance with the Family Code of the Russian Federation, the visitor has the right to apply for a refund due to the death of the relative.
3.3.2. An application for a refund due to the death of a relative shall be submitted by the visitor (his/her representative) to the Exhibition's ticket office or sent by registered mail with the list of enclosures and return receipt requested, or electronically, indicating the enclosed documents, no later than the date of the visit indicated on the ticket.
3.3.3. The submission of an application for a refund in connection with the death of a relative at the Exhibition's cash desk shall be made upon presentation of the visitor's (his/her representative's) ID document. A copy of the visitor's ID document, if sent by mail or electronically, shall be attached to the application for a refund due to the death of a relative.
3.3.4. An application for return on the death of a relative shall be accompanied by:
a) the original unused ticket to the Exhibition or a printed copy of the unused e-ticket, as well as a copy of the electronic cash register receipt;
b) a copy of the death certificate of the person who was a member of the visitor's family or a close relative, or a copy of the death certificate (certificate) of such a person issued by the civil registry office;
c) copies of documents confirming that the deceased person was a member of the visitor's family (spouse, father, mother, son or daughter (adoptive parent or adopted child) or a close relative of the visitor (grandfather, grandmother, grandson (granddaughter), full and half brothers or sisters).
3.3.5. If an application for return in connection with the death of a relative is submitted by the visitor's representative, copies of documents confirming legal representation, or a duly executed power of attorney, shall be attached to such an application.
3.3.6. In case the visitor cannot present the documents specified in subparagraphs "b" and "c" of paragraph 3.3.4. of these Rules within the deadline specified in paragraph 3.3.2. of these Rules, the visitor is entitled to present such documents within 14 days from the date of visiting the Exhibition specified in the ticket/e-ticket, on condition that the visitor presents the refund application due to death of a relative and other documents specified in this section within the deadline specified in paragraph 3.3.2. of these Rules. If the visitor submits an application for refund in connection with the death of a relative in electronic form, the visitor shall present the original application for refund in connection with the death of a relative and the documents specified in paragraph 3.3.4. of these Rules no later than 14 days from the date of the visit to the Exhibition specified in the ticket/e-ticket.
3.3.7. An application for return in connection with the death of a relative and the documents attached thereto shall be accepted and registered on the day of their receipt. At the request of the visitor (his/her representative), a note of receipt of the application for return in connection with the death of a relative and the attached documents with an indication of their list and the date of receipt shall be made on a copy of the application for return in connection with the death of a relative, or a response of receipt shall be sent to the email address specified in the application for return in connection with the death of a relative (in case the need to send a note of receipt by email is indicated in the application for return in connection with the death of a relative).
3.3.8. Within 10 days from the date of receipt of the application for return in connection with the death of a relative and the documents attached thereto the Ticket agent examines them. If necessary, this period of consideration can be increased up to 20 days.
In cases stipulated by paragraph 3.3.6. of these Rules, the period of consideration is calculated from the date of receipt by the Ticket agent in full of the documents specified in paragraph 3.3.4. of these Rules.
3.3.9. Based on the results of the review of the application for a refund in connection with the death of a relative and the documents attached thereto, the Ticket Agent makes a decision to refund the funds for the unused ticket/e-ticket or to refuse to refund the funds in case the visitor fails to comply with the conditions specified in paragraph 3.3.12 of these Rules, and informs the visitor (his representative) about it.
3.3.10.The Ticket agent informs the visitor (his/her representative) about the decision to refuse a refund indicating the conditions stipulated by paragraph 3.3.12 of these Rules, non-compliance of which was the basis for such refusal, not later than 5 days from the date of such decision one of the following ways:
a) serves the visitor (his or her representative) a notice of refusal of a refund;
b) send a notice of refusal of a refund by registered mail with return receipt requested to the address specified in the application for a refund in connection with the death of a relative;
c) send a copy of the notice of refusal of refund to the e-mail address specified in the application for refund in connection with the death of a relative.
The method of notifying the visitor of the Ticket Agent's decision to refuse a refund is specified by the visitor in the application for refund in connection with the death of a relative.
3.3.11.The Ticketing agent notifies the visitor (his/her representative) about the decision to refund the full cost of the ticket/e-ticket no later than 3 days from the date of such decision by e-mail or phone. The way of notifying the visitor about the decision of the Ticketing agent about the refund is indicated by the visitor in the application for the refund in connection with the death of a relative. The Ticket agent refunds the money to the visitor no later than 10 days after the decision to refund the money has been made. The method of refunding the visitor is determined similar to the method of payment for the ticket by the visitor.
3.3.12.In case a visitor refuses to attend the Exhibition due to documented circumstances related to the death of a person who was a family member or a close relative under the Russian Federation Family Code, the visitor has the right to return the ticket/e-ticket under the following conditions:
a) the form and details of the ticket/e-ticket correspond to the approved form and details; the design elements of the ticket/e-ticket correspond to the design elements established by the Exhibition Organizer, the ticket/e-ticket does not contain any corrections and is not forged;
b) an application for return in connection with the death of a relative, together with the documents enclosed thereto (except as provided by Clause 3.3.6 of these Regulations), is submitted to the Ticket Agent or is sent by registered mail with the list of enclosures and return receipt requested no later than the date of attendance at the Exhibition as specified in the ticket/e-ticket;
c) the documents specified in paragraph 3.3.4. of these Rules are submitted within the deadline set forth in paragraph 3.3.2. of these Rules;
d) the application for return in connection with the death of a relative and the documents attached thereto are submitted in accordance with the provisions stipulated in paragraphs 3.3.2. - 3.3.5. of these Rules;
e) the documents submitted contain reliable information;
f) the death of a visitor's family member or a close relative has occurred not earlier than 14 days before the date of attendance at the Exhibition as specified in the ticket/e-ticket, and not later than the date of attendance at the Exhibition as specified in the ticket/e-ticket;
g) the death of a member of the visitor's family or a close relative occurred after the date on which the visitor purchased the ticket/e-ticket.
4. Ticket exchange rules.
4.1. The Buyer may exchange (no more than once) an earlier purchased ticket no later than 24 hours prior to the date specified in the ticket for another date.
The transfer will be made for tickets of the same price category. If there is a change in the price of the Exhibition between the time the Buyer purchased the ticket and the time he/she requests the transfer, the transfer will be made on the condition that the Visitor pays the corresponding price difference.
4.2. Tickets for which the date of attendance has been postponed are not refundable.
5. Other terms and conditions.
5.1. Family Ticket and Group Ticket are a single product, no refund or exchange of such tickets/e-tickets is allowed piecemeal.
5.2. In case of damage, deterioration or loss, duplicates are not issued and cash is not refunded.
5.3. Tickets purchased at the points of sale specified in clauses 2.1. and 2.2. of these Rules are subject to refund and exchange.
5.4. In cases where the Exhibition is cancelled at the initiative of the Organizer, the cost of the returned tickets shall be refunded to the buyer in full (100 percent of the ticket price).
5.5. The refund of tickets in case of the Exhibition cancellation is provided from the moment of the official notification about the Exhibition cancellation till the date of the visit which is indicated in the ticket/e-ticket. The official notification means the placement of relevant information in the ticket/e-ticket sales points specified in Clauses 2.1. and 2.2. of these Regulations.
5.6. An unused ticket does not entitle the holder to visit the Exhibition on other dates.
5.7. The Organizer shall be entitled to unilaterally change the conditions of ticket sale and refund, posting them in the Exhibition's ticket sales area and on the official website at least one day in advance.
5.8. The visitor's (buyer's) subjective assessment of the epidemiological situation related to the spread of coronavirus infection caused by 2019-nCoV as unfavorable is not a reason for the visitor to refuse tickets and refund the money paid.
5.9. In case of publication of regulatory legal acts of state bodies of the Russian Federation on the ban on holding mass events, the Organizer shall carry out the postponement of the Exhibition to the dates after the cancellation of the restrictive regimes. If the Organizer has not determined the date and time of the postponed Exhibition no later than 6 months from the date of cancellation of the restrictive regimes, such Exhibition shall be deemed cancelled and the Organizer shall refund the full cost of the ticket to the visitor on his own initiative.
